Background
Lemcoe Precision, LLC at shop.lemcoe.com, is a Federal Firearms Licensed (FFL) Manufacturer/Dealer, Type 7, and holds the status of Special Occupational Taxpayer (SOT, Class 2). Lemcoe Precision, LLC can manufacture and/or transfer firearms, including NFA (National Firearms Act) items.
Any firearms purchased from Lemcoe Precision, LLC will be transferred to you by Lemcoe Precision, LLC or transferred to a Federal Firearms Licensed (FFL) dealer selected during the online checkout process. When the firearm is received by the selected FFL, Lemcoe Precision, LLC has no responsibility for the transaction between you and the selected FFL, including paperwork, background checks, or any fees associated with the transaction.
By placing an order with Lemcoe Precision, LLC at shop.lemcoe.com, you are agreeing to the below statements and terms of sale, as well as agreeing to abide by any local, state, and/or federal regulations and laws.

Customer Affidavit
I am not currently less than twenty-one (21) years old, if I am purchasing a handgun or handgun ammunition and not less than eighteen (18) years old, if I am purchasing a rifle, shotgun, rifle ammunition or shotgun ammunition
By selling or delivering ammunition and/or firearms accessories to me, Lemcoe Precision, LLC is not violating any state or local law or ordinance
I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year
I am not a fugitive from justice
I am not an unlawful user or addicted to any controlled substance
I have not been adjudicated as a mental defective and I have not been committed to any mental institution
I am not an illegal or unlawful alien, and I am not a nonimmigrant alien
I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions
I have not renounced my U.S. citizenship
I am currently not subject to a domestic violence restraining order of any kind
I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence
I will not conduct an unauthorized export of any defense articles or unlawfully export any itemsAgreement to Indemnify and Defend for Misrepresentation
If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are untrue, you agree to release, hold harmless, indemnify, and pay to defend Lemcoe Precision, and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.
Agreement to Return Firearm if ATF Background Check is not Passed
If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are not true; you purchase a firearm, including any NFA (National Firearms Act) items, for transfer to the Federal Firearms Licensed Dealer (FFL) selected by you; and, you do not pass the required ATF (Bureau of Alcohol, Tobacco, Firearms and Explosives) background check performed by the selected FFL to take possession of the firearm, you agree that the selected FFL will immediately return the firearm to Lemcoe Precision, LLC. You will forfeit the full purchase amount, including all taxes and shipping fees, and be charged for the cost of shipping the order back to our warehouse. To be clear, you will not receive a refund if you fail to pass the ATF requirements to take possession of your order.
Shipping and Fees
Lemcoe Precision, LLC does our best to ensure that your order reaches your door as quickly and as trouble-free as possible. At checkout, you will have the opportunity to designate the address to which you would like your products shipped. Firearms must be shipped to a Federal Firearms Licensed (FFL) dealer which you select. You cannot change this information after checkout.
A shipping fee is included for each purchase. This fee covers the cost of shipping from the warehouse to either Lemcoe Precision, LLC OR to the selected FFL dealer for transfer. Significant communication and attention to process is required by Lemcoe Precision, LLC to transfer the firearm to a third-party FFL. For this service, Lemcoe Precision, LLC retains the right to charge the customer a Transfer Coordination Fee. Also, not all warehouses or firearms manufacturers allow direct shipping to a third-party FFL. If Lemcoe Precision, LLC cannot have the purchase shipped directly to the selected FFL dealer for transfer, Lemcoe Precision, LLC also retains the right to charge the customer an additional shipping fee to cover the cost of the second shipment. Lemcoe Precision, LLC will notify the customer of these fees and must receive payment prior to Lemcoe Precision, LLC initiating the fulfillment process.
Title to your non-firearms products will transfer to you once they are delivered to the address you provided at checkout, based on the delivery date and time reflected in the shipping carrier’s records. Once your products are delivered, you assume all responsibility for them, including the risk that they may be stolen or damaged. You release Lemcoe Precision, from all liability and responsibility for your products after they are delivered.
Shipping Destination Restrictions
Lemcoe Precision, LLC does not ship outside the United States or to Alaska, Hawaii, California, Massachusetts, Chicago, New York City, or any other area within the United States where we are prohibited by law from shipping product. If you attempt to have product shipped to these restricted areas, your order will be cancelled and you will be subject to the cancellation fee described below.
Order Cancellation or Refusal to Accept Delivery by Customers
We want to provide you with excellent customer service. This includes shipping your order as quickly as possible. Once our system starts the fulfillment process, you may not cancel or change your order. Additionally, for your security, we cannot alter any product information or credit card charges after your order has been submitted.
By placing an order with Lemcoe Precision, LLC, you agree to accept delivery of your order at the designated FFL or shipping address designated at checkout. If you fail or refuse to accept delivery of your order, then you will forfeit the full purchase amount, including all taxes and shipping fees, and be charged for the cost of shipping the order back to our warehouse. To be clear, you will not receive a refund if you fail or refuse to accept delivery of your order.
Order Cancellation by Lemcoe Precision, LLC
We do not like canceling orders, but we reserve the right to cancel your order if you do not abide by these Terms and Conditions. If we choose to cancel your order, you will receive a refund of the full purchase amount less a cancellation fee of 6% of the total purchase amount, which covers credit card processing fees.
Returns
Due to the unique nature of the products we sell, we only accept returns for damaged or defective products. This does not include damage to boxes or packaging, only to the products themselves. Products must be returned within 30 days of your order date.
To initiate a return, please e-mail us at ffl@lemcoe.com so one of our team members can send you a Return Request form to complete. We will not issue a refund for any products returned to our warehouse that do not have an approved Return Request form on file.
You must complete the Return Request form in full. Any damage must be noted in your form and you must supply pictures documenting the damage. Once you complete and return the form, we will review it to determine whether, in our discretion, your products are eligible to be returned. If your return is approved, we will send you a pre-paid shipping label so that you can send the damaged products back to our warehouse. You are responsible for properly packing and securing your products to protect them from damage during transit back to us. All returned products are examined upon arrival at our warehouse. Once we receive and examine your return, we will either send you a replacement or issue you appropriate store credit. Only products in new/sellable condition will receive a full credit, unless the damage occurred in transit to you and you properly notified and documented the damage in your Return Request form.
Release of Liability and Agreement to Indemnify and Defend
Lemcoe Precision, LLC strives to offer high quality products and excellent customer service and is a retailer of products that are designed, manufactured, and tested by other companies. Therefore, you agree that Lemcoe Precision, shall not be liable for any claims or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, in any way related to any of the products designed, manufactured and tested by other companies and listed on shop.lemcoe.com.
Furthermore, you understand and acknowledge that Lemcoe Precision, disclaims all liability for the accuracy of information provided to you, and for how you use information provided to you, by Lemcoe Precision, LLC. You understand and acknowledge that Lemcoe Precision, cannot be held liable for how you or anyone else uses any information received from us. Therefore, you agree to release, hold harmless, indemnify, and pay to defend Lemcoe Precision, and its owners, agents, officers, and employees against any damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to your use of information provided by Lemcoe Precision, LLC. You further understand that manufacturers are the best resources for information about their products, including critical safety information. You must review all information and safety warnings from product manufacturers before purchasing and using products from shop.lemcoe.com.
By placing an order with Lemcoe Precision, LLC, you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend Lemcoe Precision, and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including, but not limited to, the use, storage, or transportation of the product. If any other party files a claim of any kind against Lemcoe Precision, arising out of or relating to your purchase, use, storage, or transportation of products from shop.lemcoe.com, you will indemnify and pay to defend Lemcoe Precision, and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.
Jurisdiction
You agree that if you choose to file a lawsuit against Lemcoe Precision, or any of its owners, agents, officers, or employees, that lawsuit must be filed in a court located in Fulton County, Georgia. You agree that any lawsuit filed in any other jurisdiction shall be immediately removed to Fulton County, Georgia and that you will reimburse Lemcoe Precision, and its owners, agents, officers, and employees for any costs, including reasonable attorneys’ fees, they incur in defending a lawsuit or effecting its removal until the lawsuit is properly before a court in Fulton County, Georgia.
Governing Law
You agree that Georgia law will govern (i) your purchase and use of any products from shop.lemcoe.com; (ii) any information you receive from shop.lemcoe.com; (iii) any legal action instituted against you by Lemcoe Precision, LLC, ; and (iv) any legal action you institute, or that someone else institutes as a result of your actions, against Lemcoe Precision, LLC .
Severability
You agree that if a dispute between the parties arises out of these Terms and Conditions, you would want a court in the State of Georgia to interpret this agreement as follows:
with respect to any provision that it holds to be unenforceable, by modifying that provision to the minimum extent necessary to make it enforceable or, if that modification is not permitted by law, by disregarding that provision;
if an unenforceable provision is modified or disregarded in accordance with this section - Severability - by holding that the rest of the agreement will remain in effect as written; and,
if modifying or disregarding the unenforceable provision would result in failure of an essential purpose of this agreement, by holding the entire agreement unenforceable.Class Action Waiver
You agree that any dispute resolution proceedings, including litigation, arbitration, or mediation, between you and Lemcoe Precision, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of your right to bring any claims against Lemcoe Precision, as part of, or on behalf of, any class or any other individuals.
